1. About Marina Moorage

Marina Moorage is an online platform that connects marinas with boat owners. Marinas can list available moorage slips by size and location, and boat owners can search and inquire about slips to moor their vessels.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use our Services. By using Marina Moorage, you represent and warrant that you meet these requirements.

3. User Accounts

To access certain features, you may be required to create an account. You agree to provide accurate information and keep your login credentials secure. You are responsible for all activity that occurs under your account.

4. Listings and Transactions

  • For Marinas: You are responsible for accurately describing your slips, availability, and pricing. Marina Moorage does not guarantee bookings or payment.
  • For Boat Owners: You understand that Marina Moorage does not own, operate, or control any marinas listed on the platform. All transactions and communications are between you and the marina.
  • Marina Moorage is not a party to any transaction between users and does not act as a broker, agent, or insurer.

5. Payment and Fees

Fees for listing slips and using premium services are outlined on the website. Marina Moorage may change pricing at any time, with notice provided to affected users. All payments are non-refundable unless otherwise specified.

  • Fees for Services are as stated in your Order or invoice. Unless otherwise agreed, payments are charged annually in advance.
  • You are responsible for all taxes unless you provide a valid exemption certificate.

6. Prohibited Activities

You agree not to:

  • Use the Services for unlawful purposes.
  • Post false or misleading content.
  • Attempt to interfere with or gain unauthorized access to our systems.
  • Harass, threaten, or defraud other users.

We reserve the right to suspend or terminate access for violations of these Terms.

7. Intellectual Property

All content on the platform, including text, logos, graphics, and software, is the property of Marina Moorage or its licensors and is protected by intellectual property laws. You may not reproduce or distribute this content without permission.

8. Disclaimers

  • The Services are provided “as is” without warranties of any kind.
  • Marina Moorage does not guarantee slip availability, security of any moorage location, or fitness for a particular vessel.
  • We are not responsible for user-generated content or third-party websites linked through the platform.

9. Limitation of Liability

To the maximum extent permitted by law, Marina Moorage is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services.

10. Indemnification

You agree to indemnify and hold harmless Marina Moorage and its affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.

11. Suspension of Services

We may suspend Services if:

  • You breach this Agreement.
  • Suspension is necessary to protect our systems.
